The Terms and Conditions apply to KAWAYAN HOLIDAY RESORT located in Siquijor, Philippines. The Kawayan Holiday Resort is owned and operated by Kawayan Real Estate Ventures, Inc., also based in Siquijor. The general terms and conditions are valid for all contractual partners of KAWAYAN HOLIDAY RESORT.

In the terms and conditions below, Kawayan Holiday Resort will be referred to as KHR for short. Every booking we receive is subject to these terms and conditions.

1.1 The prices for all offers are net and are considered a fixed price. However, price adjustments are possible at any time and without prior notice. Bookings that have already been made remain valid and are exempt from possible price adjustments.

1.2 Mistakes or errors caused by software in the prices listed on our website do not entitle you to receive the booked services. Corresponding errors may be adjusted by us and invoiced again without further information.

1.3 The KHR price information applies to one night in the Prestige or Deluxe Villa. The prices shown are per villa and include breakfast for two people. If only one person occupies a villa, an extra ₱ 1500 per night will be charged. Prices can change at any time

1.4 If the Prestige Villa is occupied by three (3) or four (4) people, an additional ₱ (Philippine peso) 5500 per night will be charged per extra bed. Only with permission from management.

1.5 Check-in before 2 p.m. will be charged extra. Check-in from 12 p.m. costs ₱ 800 extra per villa. Check-in before 12 p.m. will be charged at 1,900 pesos per villa if early check-in is possible. Check-in applies from the time you check in at reception. Prices can change at any time.

1.6 All transfers are chargeable. Please ask about planned trips. Prices can change at any time.

– Transfer to/from Siquijor pier ₱2000/way/van. Maximum 4 people. Additional person ₱ 300.-

– Transfer to/from Larena Pier ₱ 3100.-/way/van. Maximum 4 people. Additional person ₱ 300.-

It takes approximately 25 minutes to drive from the resort to Siquijor Pier. To Larena Pier about 50 minutes. We only transport our guests.

1.7 Extra trips with the hotel bus are subject to a charge and are generally possible if a minibus is available. Trips to Siquijor cost ₱2900 bus/way. Trips to Larena ₱ 3900.- by bus/way. Other extra trips only on request. Waiting times are charged at ₱ 300 per hour. Maximum of 4 people per trip. Additional people will be charged ₱ 400 per person. Prices can change at any time.

1.8 At least 4 (four) nights must be booked over the Christmas and New Year holidays. Villas can be blocked for guests who stay longer. Only management can grant exceptions upon request.

2.1 Every diver undertakes to respect the underwater world and dive with appropriate caution. Every diver is generally asked not to hold on to the reef.

Living beings must not be disturbed in their normal environment. This applies to every diver and especially to photographers. Wearing gloves is generally NOT allowed!

Divers who do not behave accordingly are no longer allowed to dive. The KHR is entitled to act accordingly. No refunds for pre-booked dives.

2.2 The KHR price information for diving applies to one dive per person. The price includes boat along the Siquijor coast, guide, weight and tank. For house reef dives, the guide, weight and tank are included in the price. There is a surcharge for early and night dives, whether on the house reef or by boat. Current local prices and fees apply.

2.3 The KHR decides whether and when diving takes place without a guide. A check dive is mandatory for every diver who wants to dive in the KHR. There is no entitlement to a price reduction for diving without a guide.

2.4 Depending on the weather situation, the diving center is entitled to cancel planned diving trips or dives for safety reasons. Boat trips can be replaced by car trips.

2.5 Pre-booked dives are per person and only for diving along the Siquijor coast or at the house reef. Dives are generally not transferable. If diving is no longer possible for health reasons, pre-booked dives can, as an exception, be handed over to the partner (only the diving center can decide on this exception).

2.6 Fees for the marine protected areas, rental equipment, day tours and special trips are not included in the price and must be paid on site. By the way, the fees for the marine protected areas should be paid in cash, as we have to pay this money to the local authorities.

2.7 Diving trips along the Siquijor coast by boat can only be offered if at least two people complete two dives per boat trip.

2.8 In the event of health, weather, transport, technical and/or other problems, there is generally no right to a replacement or refund of the dive price or diving package.

2.9 There will also be NO refunds for pre-booked dives that are not used or dived. You can purchase unused dives from us within four years. Accordingly, you will receive a voucher upon your departure. Diving packages are not transferable to other guests. The resort does not handle transactions

3.1 Book your stay online directly on our website. Before submitting your booking, please check whether the information you have provided is correct and complete. Incorrect or incomplete information can lead to an incorrect booking for which we accept no responsibility.

3.2 After you have made your booking, you will receive an automatically generated email from us with the booking details (please also check your spam folder). Pay for your booking in accordance with Article 4.2.

3.3 After receipt of payment, you will receive a booking confirmation from us via email (please also check your spam folder). Your booking is therefore valid. A booking that is not paid for and confirmed by the KHR Reservation Service is invalid. MINIMUM STAY TWO/THREE (2/3) NIGHTS, DEPENDING ON SEASON.

3.4 When booking, there is no entitlement to a specific villa. The KHR reserves the right to change the occupancy at any time and without giving reasons.

3.5 You are obliged to provide your booking details truthfully and the details must correspond to the current status and your official ID or passport. Misleading or false information regarding the person making the booking entitles KHR to withdraw from the contract and cancel the booking without refund.

3.6 The KHR can withdraw from the contract immediately and cancel the booking without refund if the guests do not behave in accordance with the hotel rules (for example: violence of any kind, disrespectful or dangerous behavior towards staff or other guests, destruction of hotel property, etc.)

4.1 Payments to the KHR must be made either directly via PayPal when booking online or via online transfer in SFr. (Swiss Franc), EUR (Euro), USD (US Dollar) and PHP (Philippine Pesos). In the case of a bank transfer, payment must be made to the account specified by us in the invoice.

4.2 If a booking is made, 50 (fifty) percent of the total price is due immediately. The remaining balance must be paid no later than 30 (thirty) days before departure. If we do not receive the remaining payment on time, the booking will be cancelled. In this case, there will be no refund of the deposit already paid.

4.3 As soon as we have received the deposit or payment, the booking will be confirmed by the KHR reservation office via our booking system. The booking is only valid from the status PAID. However, the resort reserves the right to cancel bookings without giving any further reasons.

4.4 The financial institutions charge the applicable fees in all cases (including cancellations and refunds). Therefore, we retain the original payment fees in full when processing business payments.

5.1 In the event of cancellation, the following costs will be charged per booking:

Cancellation is free up to 60 days before check-in and you will receive a full refund.
59 to 30 days before check-in 50% of the total amount.
29 to 20 days before check-in 80% of the total amount.
From 19 days until the day of arrival check-in 100% of the total price.
In case of no-show/no-show from the first day/early departure 100% of the total amount.

5.2 The following cancellation rules and costs apply for the months of November, December and January as well as on special holidays (Easter, Pentecost).
Up to 60 days before check-in 40% of the total amount
From 59 to 40 days before check-in 80% of the total amount
From 39 days until the day of arrival check-in 100% of the total amount.

5.3 Failure to arrive will be considered a “no-show” from the first day. This applies even in the event of “force majeure”. KHR can withdraw from the accommodation contract with immediate effect and release the villas to the public again. No refund will be given.

5.4 Any refund of bookings that have already been paid will be made within 30 (thirty) days after deducting the deductions listed under Article 5.1.

5.5 Refunds will only be made to a bank or postal account. For security reasons, the name of the account holder must match that on the booking confirmation.

5.6 The customer is responsible for sending the refund details by email to the KHR reservation office. To rule out errors, the name of the account holder, name of the bank, IBAN, clearing and BIC code are required.

5.7 We expressly recommend taking out travel insurance. This means you are well protected even in the event of “force majeure”. Make sure you choose the right policy when taking out the policy.

5.8 A flat rate of at least ₱ 3,000 to a maximum of ₱ 10,000 will be charged for all changes to an existing booking. If the length of stay is shortened or the booking is canceled, the conditions listed in Article 5.1 apply. For shorter stays, these will be charged pro rata.

6.1 The Deluxe Villa can accommodate a maximum of two people.

6.2 The Prestige Villa can accommodate two people. The Prestige Villa has a lounge or day bed.

6.3 All villas are 100% non-smoking villas. You are only allowed to smoke outside on the large terrace.

7.1 The KHR is NOT responsible for the arrival or departure of guests.

7.2 The guest himself is responsible for reaching ferries or flights on time.

7.3 If your departure or arrival is postponed, the KHR will not provide any reimbursement.

7.4 The KHR assumes no responsibility for possible failures of passenger transport (flight, ship, bus, etc.) of any kind.

7.5 Additional, unplanned overnight stays must be paid for by the guest directly on site.

7.6 We strongly recommend that you take out good travel insurance. Additional costs will probably be covered (depending on insurance and performance), or at least parts of them.

7.7 We also recommend that you include all possible events in your holiday planning.

7.8 KHR is responsible for transport to/from the pier in Siquijor, if booked. However, this only applies to bookings made through a travel agency or directly on our website. KHR management decides when and how often transfers are made. Additional transfers are charged per person. Special transportation and transfers for guests are charged PHP 400/bus/way. Siquijor PHP 2500.-, Larena PHP 3400.- by transfer.

8.1 KHR’s services and offers can change at any time. If services and/or offers cannot be carried out or offered due to weather, technical or other reasons, there is no right to compensation.

8.2 Any type of extra services (Iceland Tours, Motorbike Rental, service on the observation deck, etc.) that are booked or used in the resort must be paid extra according to the price lists or staff details and will be charged to the room bill.

8.3 If a service that has already been booked and/or organized is canceled within 12 hours, the resort will charge a cancellation fee of fifty (50) percent of the price of the booked service, but at least Pesos 100. Offset against the room bill.

8.4 The use of the observation deck to eat there is not part of the general service of the restaurant. Use must be approved by the F&B Manager or Resort Management. There is absolutely no right to use it. The additional service fee for the extra service is 2000 pesos.

8.5 The resort has a staircase with direct access to the sea. For safety reasons, the resort reserves the right to close the access or gate if weather conditions endanger the safety of guests. The same applies to heavy waves or currents. There is no right to access. However, the guest always uses the access at his own risk. The guest is responsible for his own safety.

9.1 Cash: Cash payment at the resort is preferred as this method of payment causes the least inconvenience. Currencies: CHF, EURO, U.S. Dollar and Philippine Pesos.

9.2 Bank transfer: Bank transfer is only possible on site up to 24 hours before checkout. Proof of payment must be presented. Possible currencies: CHF, EURO, U.S. dollars and Philippine pesos.

9.3 PayPal: You can pay via PayPal. A fee (+ 4.5% commission) is due for this.

9.4 GCash: You can pay via GCash. A fee (+ 2.5% commission) is due for this.

9.5 Cards: Credit cards are only accepted via PayPal. A fee (+ 4.5% commission) is also due for this. Bank BDO Philippines removed all CC terminals during COVID. We are now no longer willing to offer this service again.

9.6 The financial institutions always charge the applicable bank fees. Therefore, we retain the original payment fees in full when processing business payments.

10.1 Kawayan Holiday Resort may hold the guest or any responsible person liable to the hotel/resort for any loss or damage caused by them.

11.1 All complaints regarding LAUNDRY (shrinkage, lost buttons, etc.) must be made within 1 hour of the garment being returned. In the event of loss or damage, Kawayan Holiday Resort will be responsible for a maximum of 10 times the cost of the laundry services price for the relevant item of clothing.

11.2 An additional fee may be charged for special cleaning.

11.3 50% surcharge for 4 hours express service.

11.4 The amount will be charged to your hotel bill.

12.1 For safety and liability reasons, visitors are not permitted to enter the resort. Exceptions must be approved by management.

12.2 If approved, resort visitors must pay a fee of 500 pesos per person upon request.

12.3 If approved, visitors may stay in the resort until a maximum of 9 p.m.

12.4 If approved, visitors are not permitted to use hotel/resort facilities (swimming pool, loungers, etc.) without management permission.

12.5 If approved, the instructions of the staff or management must be followed in all cases.

Opening times daily 6:00 a.m. – 10:00 p.m

Restaurant/Bar:
Opening hours daily 7:00 a.m. – 10:00 p.m

Kitchen:
Opening hours daily 7:00 a.m. – 9:00 p.m

Diving center:
Opening times daily 8:00 a.m. – 6:00 p.m

Massage center:
Opening times daily 8:00 a.m. – 8:00 p.m

Swimming pool:
Opening hours daily 6 a.m. – 8 p.m

14.1 Visitors or guests enter the Kawayan Holiday Resort property at their own risk.

14.2 The Kawayan Holiday Resort has two dogs guarding the facility for security reasons.

14.3 As is common in the Philippines, animals such as cows, goats or roosters may be in the area around the resort and make themselves known. It is also possible that you can listen to the music of videoke, karaoke or fiestas from a distance. It’s all part of Filipino culture. The resort does not accept any complaints regarding this.

14.4 For safety and liability reasons, the Resort does not allow or approve children under 10 years of age. The resort is located on a 20 meter high cliff in the rocks.

14.5 KHR has the right to refuse entry without refund to guests who pose a danger to the resort or its employees or guests (illnesses, violent persons, etc.)

14.6 The KHR declines any liability.
