Terms & Conditions

The General Terms & Conditions apply to the KAWAYAN HOLIDAY RESORT located in Siquijor, Philippines. The Kawayan Holiday Resort is owned and operated by Kawayan Real Estate Ventures, Inc., headquartered in Siquijor.” The General Terms & Conditions apply to the KAWAYAN HOLIDAY RESORT located in Siquijor, Philippines.

1.1 The prices for all offers are net prices (after taxes) and are considered fixed prices. Price adjustments are possible at any time, however, and may occur without prior notice. Bookings that have already been made remain valid and are excluded from possible price adjustments.

1.2 Mistakes or software-related errors in prices listed on our website do not entitle one to the booked benefits and services. Such errors may be adjusted and recalculated or discounted by us without additional information.

1.3 The KHR price quotes always apply to one night in either the Prestige or Deluxe Villa. The prices listed are per Villa and include breakfast for two people. If only one person occupied a villa 1500.- pesos will be charged extra per night.

1.4 If the Prestige villa will be occupied by three people or more, the fallowing charges will be charged: PHP 800.- for a child older the 10 years or PHP 1500.- (Philippine Peso) for one adult (from the age of 16). For security and liability reasons children under 10 years are not permitted.

1.5 Early check-in before 2 PM will be charged extra. From 12 noon the charge is 800.- Pesos per villa. Before 12 noon 1900.- Pesos will be charged if an early check-in is possible. CheckIn is applicable from the time you checked-in at the front desk.

1.6 All transfers are subject to a charge. Please ask for planned trips.
-Transfer to/from the pier of Siquijor PHP 1000.-/way/van. Maximum 4 persons. Additional person PHP 300.-
-Transfer to/from the pier in Larena PHP 1800.-/way/van. Maximum 4 persons. Additional person PHP 300.-

From the resort to the pier of Siquijor, there are approximately 25 minutes to drive. To Larena Pier approximately 50 to 60 minutes. We transport our guests exclusively.

1.7 Over the holidays Christmas and New Year a minimum stay of at least 7 (seven) nights is required. Villas are blocked for long stay guests. Exception on request can be made just by the management.

2.1 All divers undertake to respect the underwater world and according to dive carefully. All divers are asked not generally hold onto the reef.
Beings must not be disturbed in their environment. This applies to all divers especially for photographers. Wearing gloves is generally not allowed! Divers who may not behave accordingly not dive. The KHR is entitled to act appropriately. No refunds provided for pre-booked dives.

2.2 The price quotes for diving in the KHR always apply to one diving session per person. Included are: boat along the coast of Siquijor, guide, weights and the diving tank. For house reef dives guide, lead, and the tank are included in the price. There is a surcharge for early morning and night dives.

2.3 Pre-booked diving apply per person and only for diving along the coast of Siquijors and/or at the house reef. Dives are generally not transferable. Because health reasons only pre-booked dives can be given to the partner (only the divecenter can decide about this exception).

2.4 The KHR can decide whether you can dive with or without a guide. A check dive is compulsory for every diver who wants to dive in KHR​​. There is no justification for price reduction without a guide

2.5 Sanctuary fees, rental equipment, day tours, and special trips are not included in the price and must be paid for on site.

2.6 Diving trips by boat can only be offered if there are at least two divers for two dives each boat trip.

2.7 Health, Transport, Weather and / or other problems are not entitled to replacement or refund of the dive price.

2.8 For pre-booked dives that were not used will be paid NO refund. Unused dives can be obtained within four years. Accordingly, you will receive a voucher when leaving. Diving packages are not transferable to other guests. The resort accepts no transactions.

3.1 You can conveniently make your bookings online via our website. Before you send us your booking, please check to see that all of the information you have provided is correct and complete. Incorrect or incomplete information can result in an erroneous booking for which we take no responsibility.

3.2 After your booking has been made, you will receive an automatically generated invoice from us by e-mail (please check your spam folder). Pay your booking according to Article 4.2.

3.3 After you have submitted payment, we will send you a booking confirmation by e-mail (please check your spam folder). The booking is therefore valid. A booking that has not been confirmed by the KHR Reservation Service is invalid. MINIMUM STAY OF TWO/THREE (2/3) NIGHTS, DEPENDING ON SEASON.

3.4 Bookings via booking websites like Agoda, Expedia group or Booking.com is subject to our terms and conditions. Additional nights will be charged at the current hotel tarif.

3.5 When booking, there is no right to a particular villa. The KHR reserves the right to change the assignment at any time without giving reasons.

4.1 Payments to the KHR must be made by PayPal direct.

4.2 When a booking is made, 30 (thirty) percent of the total price is due within 10 (ten) days. The balance must be paid 30 (thirty) days prior to departure. If the balance is not paid on time, the booking will be cancelled. The initial down payment will not be refunded.

4.3 As soon as we receive the down payment or payment, the booking will be confirmed by the KHR Reservation Service via booking system. The booking is valid only after the booking is confirmed. However, the resort reserves the right to cancel bookings without further explanation.

5.1 When a booking is cancelled, the following charges are made per booking:
Up to 60 days prior to arrival 30% of the total (Min. PHP 10000.-)
59 to 30 days prior to arrival 60% of the total (Min. PHP 10000.-)
29 to 20 days prior to arrival 90% of the total (Min. PHP 10000.-)
From 19 days till arrival day 100% of the total (Min. PHP 10000.-)
No-Show/Early Departure 100% of the total (Min. PHP 10000.-)

5.2 Reservations for the month of December and January as well as of main holidays can be cancelled only up to three months in advance. After that, there are no refunds. Not arrive is considered a no-show and no refunds will be awarded.

5.3 A possible refund for bookings that have already been paid is made within 30 (thirty) days according to the allowance of the deductions listed under Article 5.1.

5.4 The refund is made only to a bank or postal account. For security reasons, the name of the account holder must match the name on the booking confirmation.

5.5 Transferal of the refund data to the KHR by e-mail is the sole responsibility of the person making the booking. In order to eliminate mistakes, the name of the account holder, bank name, IBAN, Clearing code, and BIC Code are required.

5.6 No exceptions are made to our cancellation policy, including weather and personal emergencies. Please purchase trip insurance to cover you in case an illness forces you to cancel a tour. There is no refund for arriving late or departing early, or services not used. KHR is not responsible for cancellations, amendments, or additional fees incurred by clients due to acts of nature, civil unrest, terrorism, strikes, work stoppage, or inclement weather. KHR reserves the right to cancel a booking. While this is rare, in the event of cancellation, a full refund will be sent to the client and constitutes full settlement.

5.7 We strongly recommend cancellation and accident insurance to prevent any losses in case of illness, accident or otherwise.

5.8 The modification of an existing booking a fee of PHP 2500.- will be charged per change.

6.1 The Deluxe Villa is suitable for two people. No additional beds are possible.

6.2 The Prestige Villa is suitable for two people. Up to two extra bed’s are possible on request. Surcharge listed under Article 1.4.

7.1 The Kawayan Holiday Resort is not responsible for arrivals or departures.

7.2 The guest alone is responsible for catching ferries or planes in a timely fashion. The KHR grants no refunds for early departures.

7.3 The KHR accepts no responsibility for the possible cancellation of any type of passenger transportation (airplane, ship, bus, etc.). This also includes transfers offered by the KHR.

7.4 Additional overnight stays must be paid on site by the guest.

7.5 The KHR is responsible for the transportation to/from the pier in Siquijor. This applies, however, only for bookings made via a travel agent. Time and how often transfers take place decides the KHR. Additional transfers will be charged per person. Special transportations and short stay guest (less than 4 nights) are subjects to charge PHP 300.-/Pax. Minimum charge per transfer PHP 600.-

7.6 No exceptions are made to our cancellation policy, including weather and personal emergencies. Please purchase trip insurance to cover you in case an illness forces you to cancel a tour. 7.7 We strongly recommend cancellation and accident insurance to prevent any losses in case of illness, accident or otherwise.

7.8 You should include contingencies for your vacation planning.

7.9 It is NOT allowed to bring your own food and drinks, including mineral water, because of hygienic and waste reasons (disposal, ants, geckos, etc.). If you still do, a flat service fee in the amount of PHP 2000.- will be charged from the resort.

8.1 The services and offerings of the KHR can change at any time. If services and/or offerings cannot be provided due to weather conditions or technical or other reasons, no claim can be made for reimbursement or compensation.

8.2 Any kind of extra services (Iceland tours, motorbike rental, service on the viewing deck, etc.) which are booked at the resort will need to be paid extra according to the price lists or personal information. It will be charged to the room account.

8.3 If an already booked or organized service is cancelled within 12 hours, the resort will charge a cancellation fee in the amount of ten (10) percent of the price of the booked service, but at least pesos 100.-. It will be charged to the room account.

8.4 The use of the viewing deck to eat does not belong to the general service of the restaurant. The use must be approved by the F & B Manager or the resort management. There is no entitlement to use. The additional service fee for the extra service is 500.- Pesos.

8.5 The resort features a staircase providing direct access to the sea. The resort reserves the right for security reasons to close the gate when the weather conditions could endanger the safety of the guests. The same applies to heavy waves or current. There is no entitlement to access. The guest uses the access at his own risk. The guest is responsible for his own safety.

9.1 Cash: Cash is the preferred payment method at the resort as this causes the least circumstances. Furthermore, it is possible that the credit system is not accessible online. Currency: CHF, Euro, U.S. Dollars and Philippine Pesos.

9.2 Cards: We accept the following cards: Mastercard, Visa (+ 5% commission).

* It is possible that the system is not accessible online. For this case, the payment either in cash or by e-banking will be settled. Settlement of you bill should be the night before departure not later than 4 PM at the reception. Balances must be paid in cash shortly before departure.

10.1 The guest will be held responsible for any loss or damage to the hotel property caused by themselves, their guests or any person for whom they are responsible.

11.1 All claims or complaints relating to laundry (shrinkage, lost button or fading etc.) must be made within 24 hours of garment return. In case of loss or damage, the Kawayan Holiday Resort will only be limited to a maximum of 10 times the cost of service. Additional fee may be charged for special cleaning.

11.2 Additional fee may be charged for special cleaning.

11.3 50% Surcharge for express service within 4 hours.

11.4 The amount will be added to your hotel bill.

12.1 Because of safety and liability reasons it is visitors not allowed to enter the resort. Exceptions need approval of the management.

12.2 If approved resort visitors have to pay a fee of 300.- pesos per person.

12.3 If approved visitors are only allowed to stay maximum until 10 pm at the resort.

12.4 If approved it is visitors not allowed to use hotel/resort facilities (swimming pool, deck chairs, etc.) without permission of the management.

12.5 If approved you have to follow instructions given by the staff or management.

13.1 Visitors or guests enter the property of the Kawayan Holiday Resort at their own risk.

13.2 The Kawayan Holiday Resort has two dogs for security guarding the facility.

13.3 As in the Philippines usual it is possible, that there are animals such as cows, goats or rooster in the surroundings of the resort and that they might become noticeable. It is also possible that you can hear the music of videoke, karaoke or fiestas from far away. It is all part of Filipino culture. The resort accepts no complaints in this regard.

13.4 For security and liability reasons the resort does not allow or accept children’s. The resort is located on 20 meter high cliff in the rocks.

13.5 The KHR disclaims all liabilities.
