These Terms and Conditions apply to the Kawayan Holiday Resort (KHR), located in Siquijor, Philippines. The resort is owned and operated by Kawayan Real Estate Ventures, Inc., also based in Siquijor. The Terms and Conditions are binding for all contractual partners of KHR.

In the following, Kawayan Holiday Resort will be referred to as KHR. Every booking received is subject to these Terms and Conditions.

1.0 Prices

1.1 All prices are net prices and are fixed. Prices are subject to change without notice. Existing bookings remain valid and are exempt from any price adjustments.

1.2 Errors or software-related mistakes in the prices listed on our website do not entitle guests to the booked services. We may correct such errors without further notice and recalculate accordingly.

1.3 The prices quoted by KHR are per night for the Prestige and Deluxe Villas. Prices are per villa and include breakfast for two people. A surcharge of ₱ 1,700.- per night applies for single occupancy of a villa. Prices are subject to change without notice.

1.4 If the Prestige Villa is occupied by three (3) or four (4) people with the approval of the hotel management, an additional charge of ₱ 5,500.- per night will be applied for each extra bed. Extra beds are available only upon request and in exceptional circumstances. This provision applies exclusively to direct bookings made through our official website.

1.5 Check-in before 2:00 PM will incur an extra charge. Check-in after 12:00 PM costs ₱ 800.- extra per villa. Check-in before 12:00 PM will be charged at ₱ 1500.- per villa, provided early check-in is possible. Check-in begins upon arrival at reception. Prices are subject to change.

1.6 All transfers are subject to a charge. Please inquire about scheduled transfers. The transfer time from the resort to Siquijor Pier is approximately 25–30 minutes, and to Larena approximately 45–50 minutes. Please note: Our transportation service is exclusively available to our resort guests. Prices are subject to change.

– Transfer to/from Siquijor Pier: ₱ 2600.- each way per van. Maximum 4 people. Additional person ₱ 600.-
– Transfer to/from Larena Pier ₱ 3200.-/one way/van. Maximum 4 people. Additional person ₱ 600.-

1.7 Extra trips with the hotel shuttle bus are available for a fee and are generally possible if a minibus is available. Trips to Siquijor are charged at ₱ 3,300.- each way, trips to Larena at ₱ 4,500.- each way. Other extra trips are available only upon request. Waiting time is charged at ₱ 500.- per hour. A maximum of 4 people are allowed per trip; additional people are charged at ₱ 600.- per person. Prices are subject to change without notice.

1.8 A minimum stay of 4 nights applies over the Christmas and New Year holidays. Villas can be reserved for guests with longer stays. Exceptions are possible only upon request and with management approval.

2.0 Diving

2.1 We ask all divers to treat the underwater world with respect and dive carefully. Please do not hold onto the reef and do not disturb marine life in its natural habitat – this applies especially to photographers. Gloves are not permitted while diving. If these rules are not followed, we reserve the right to exclude divers from further diving. In this case, dives already booked cannot be refunded.

2.2 KHR's diving prices are per person and per dive. The price includes boat, guide, weights, and tank. For house reef dives, the guide, weights, and tank are included. We charge a surcharge for early morning and night dives – on the house reef or by boat. The current prices and fees on site apply.

2.3 KHR determines whether dives without a guide are permitted. Every diver must first complete a check dive. No price reduction is granted for independent dives without a guide.

2.4 Guides typically accompany divers, with two to four participants assigned per guide. While the dive center operates under Swiss management, guides and instructors provide communication in English. A German‑speaking cannot be assured at all times.

2.5 The safety of our guests is our top priority. Therefore, the dive center may cancel planned dive trips or dives due to inclement weather. Weather permitting, we will replace boat trips with bus trips in such cases.

2.6 Pre-booked dives are per person and are only valid for dives along the Siquijor coast or on the house reef. Transfers are generally not possible. If a diver is unable to continue diving for health reasons, the dive center may decide on a case-by-case basis whether the dives can be transferred to their partner.

2.7 Additional fees for marine protected areas, rental equipment, day trips, and special excursions are not included in the price and will be collected on-site. We kindly request that marine protected area fees be paid in cash, as we must forward these directly to the local authorities.

2.8 Boat dive trips along the Siquijor coast are possible if at least two guests each complete two dives per trip.

2.9 If health, weather, transportation, or technical reasons prevent diving, we unfortunately cannot offer refunds or replacements for booked dives or dive packages.

2.10 Please note: No refunds will be issued for pre-booked dives that are not used. You can redeem these within four years and will receive a corresponding voucher upon your departure. Dive packages are non-transferable. Financial transactions are not processed by the resort.

2.11 Agreed-upon dives are binding. For cancellations on the day of the dive, we charge a fee of ₱ 1,000.- per person to cover the costs of the boat, equipment, and staff.
The cancellation fee is waived if the cancellation:
- occurs the evening before the scheduled dive day,
- is demonstrably necessary for health reasons,
- the weather conditions do not permit diving.
The decision rests with our dive center staff.

Each guest is responsible for being physically fit to dive and for arriving accordingly.

3.0 Bookings

3.1 Book your stay online directly on our website. Before submitting your booking, please check whether the information you have provided is correct and complete. Incorrect or incomplete information can lead to an incorrect booking for which we accept no responsibility.

3.2 After you have made your booking, you will receive an automatically generated email from us with the booking details (please also check your spam folder). Pay for your booking in accordance with Article 4.2.

3.3 After receipt of payment, you will receive a booking confirmation from us via email (please also check your spam folder). Your booking is therefore valid. A booking that is not paid for and confirmed by the KHR Reservation Service is invalid. MINIMUM STAY TWO/THREE (2/3) NIGHTS, DEPENDING ON SEASON.

3.4 When booking, there is no entitlement to a specific villa. The KHR reserves the right to change the occupancy at any time and without giving reasons.

3.5 You are obliged to provide your booking details truthfully and the details must correspond to the current status and your official ID or passport. Misleading or false information regarding the person making the booking entitles KHR to withdraw from the contract and cancel the booking without refund.

3.6 The KHR can withdraw from the contract immediately and cancel the booking without refund if the guests do not behave in accordance with the hotel rules (for example: violence of any kind, disrespectful or dangerous behavior towards staff or other guests, destruction of hotel property, etc.)

4.0 Payment

4.1 Payments for bookings at Kawayan Holiday Resort must be made online either directly via PayPal or by online bank transfer in PHP (Philippine Pesos). For payments via PayPal, the booking is confirmed immediately and is then valid. For bank transfers, the booking is only valid after receipt of payment and must be made to the account specified in our invoice.

4.2 A deposit of 50% of the total price is due immediately upon booking. The remaining balance must be paid no later than 30 days prior to departure. If the remaining balance is not paid on time, the booking will be canceled. In this case, the deposit already paid will not be refunded.

4.3 Once the deposit or full payment has been received, the booking will be confirmed by the Kawayan Holiday Resort reservation office in the booking system. A booking is only considered binding once the status "PAID" is displayed. The resort reserves the right to cancel bookings without giving reasons.

4.4 Financial institutions always charge fees – even for cancellations or refunds. These fees are fully retained when processing business payments.

5.0 Cancellations, Changes, No shows

5.1 In the event of cancellation, the following costs will be charged per booking:
Travelers who cancel at least 90 days before arrival will be charged no cancellation fee.
Travelers who cancel between 90 and 60 days before arrival will be charged a fee equal to 50% of the booking amount.
Travelers who cancel between 60 and 30 days before arrival will be charged a fee equal to 80% of the booking amount.
Travelers who cancel less than 30 days before arrival (including no-shows) will be charged a fee equal to 100% of the booking amount.
In case of no-show from the first day/early departure 100% of the total amount.

5.2 Cancellations of discounted rates labeled “Non‑refundable Price” as well as special offers granted by management are strictly excluded. Refunds are not possible under any circumstances.
We therefore strongly recommend that you purchase travel insurance.

5.3 Failure to arrive will be considered a “no-show” from the first day. This applies even in the event of “force majeure”. KHR can withdraw from the accommodation contract with immediate effect and release the villas to the public again. No refund will be given.

5.4 Any refund of bookings that have already been paid will be made within 30 (thirty) days after deducting the deductions listed under Article 5.1.

5.5 Refunds will only be made to a bank or postal account. For security reasons, the name of the account holder must match that on the booking confirmation.

5.6 The customer is responsible for sending the refund details by email to the KHR reservation office. To rule out errors, the name of the account holder, name of the bank, IBAN, clearing and BIC code are required.

5.7 We expressly recommend taking out travel insurance. This means you are well protected even in the event of “force majeure”. Make sure you choose the right policy when taking out the policy.

5.8 A flat rate of at least ₱ 3,000 to a maximum of ₱ 10,000 will be charged for all changes to an existing booking. If the length of stay is shortened or the booking is canceled, the conditions listed in Article 5.1 apply. For shorter stays, these will be charged pro rata.

6.0 Villas

6.1 Access to all villas is reserved exclusively for booked guests. No exceptions!

6.2 The Deluxe Villa and the Prestige Villas can accommodate a maximum of two (2) people.

6.3 Upon prior request and with the resort's approval, up to two (2) extra beds can be provided in the Prestige Villas. This is only possible with a minimum stay of four (4) nights and is subject to availability. The final decision rests with management.

6.4 An extra bed costs 3,900 pesos per person per night, including breakfast. Extra beds will be added to your room bill on-site. Please note that bookings made through third-party providers (e.g., Agoda or Expedia) are excluded from these benefits. Our rates may vary seasonally.

6.4 All villas are 100% non-smoking villas. You are only allowed to smoke outside on the large terrace. Violations will be subject to a fine of 5000.- Pesos.

7.0 Disruptions and Delays

7.1 Guests are responsible for their own arrival and departure; Kawayan Holiday Resort cannot accept any liability in this regard.

7.2 Guests are responsible for making their own ferry or flight appointments.

7.3 In the event of an early departure, Kawayan Holiday Resort is unfortunately unable to offer a refund.

7.4 Kawayan Holiday Resort cannot accept responsibility for cancellations of passenger transport (flights, ships, buses, etc.).

7.5 Additional nights that arise unexpectedly must be paid for by the guest directly on site.

7.6 For your safety, we recommend taking out travel insurance. This usually covers additional costs – depending on the insurance policy and coverage – in full or at least partially.

7.7 To ensure your holiday runs smoothly, we recommend including unforeseen events in your planning.

7.8 Kawayan Holiday Resort will gladly arrange your transfer – if booked in advance. This offer is valid for bookings made through travel agencies or directly via our website. The times and frequency of transfers are determined by our management. Additional transfers are charged per person.

8.0 Services & Offers

8.1 Our services and offers are subject to change at any time. If certain offers cannot be provided due to weather conditions, technical issues, or other reasons, we ask for your understanding – no compensation is provided in this case.

8.2 Additional services such as island tours, motorbike rental, or service on the observation deck can be booked directly at the resort. These services are charged separately according to price lists or staff instructions and will be added to your room bill.

8.3 For cancellations made less than 12 hours in advance of booking or arranging a service, a cancellation fee of 50% of the price, but at least ₱ 100.-, will apply. This will be added to your room bill.

8.4 The observation deck can also be used for dining upon request. As this is not part of the regular restaurant service, you will need the approval of the Food & Beverage Manager or the Resort Management. Use of the observation deck is not guaranteed. We charge a fee of ₱ 2000.- for this extra service.

8.5 You have direct access to the sea via a staircase. In case of adverse weather conditions, strong waves, or currents, the resort may close access for safety reasons. There is no guarantee of access. Use is always at your own risk.

9.0 Check-out Statement

9.1 Check-out time is 11:00 am. Late check-out after 11 am will be charged ₱ 700.-/hour.

9.2 Cash: The preferred payment method at the resort is cash in Philippine Pesos, as this simplifies the process and avoids currency exchange differences. Payments in other currencies will be processed according to the resort's own exchange rate. The acceptance of cash in other currencies is at the resort's discretion.

9.3 Bank transfer: Bank transfers are only possible on-site and must be made no later than 24 hours before check-out. Transfers in Philippine Pesos to our Philippine account are preferred. Whether transfers in other currencies are accepted is at the resort's discretion; the daily exchange rate set by the resort will apply. Proof of payment is mandatory. Your stay at the resort will remain in effect until the full amount of your bill has been paid.

9.4 PayPal: You can pay via PayPal. A fee (+ 4.5%) is due for this.

9.5 GCash: You can pay via GCash. A fee (+ 3.5%) is due for this.

9.6 Cards: Credit cards are only accepted via PayPal. A fee (+ 4.5%) is also due for this.

9.7 The financial institutions always charge the applicable bank fees. Therefore, we retain the original payment fees in full when processing business payments.

10 Property damage

10.1 The Kawayan Holiday Resort reserves the right to hold guests or any responsible persons liable for any loss or damage they cause to the resort.

11 Laundry

11.1 Complaints regarding laundry (e.g., shrinkage, missing buttons, etc.) must be reported within one hour of return. In case of loss or damage, Kawayan Holiday Resort will reimburse up to ten times the laundry price for the garment in question.

11.2 We reserve the right to charge an additional fee for special cleaning services.

11.3 A 50% surcharge applies for a four-hour express service.

11.4 The corresponding costs will be conveniently added to your hotel bill.

12 Visitors

12.1 For your security and privacy, visitors of our in‑house guests are not allowed in the resort areas reserved for guests. Any exceptions can only be approved by our staff.
Walk-in guests may only remain briefly in the designated stairwell area and are required to behave quietly and respectfully. Failure to do so will result in immediate removal from the resort.

12.2 For the comfort and privacy of our in‑house guests, resort facilities (swimming pool, sun loungers, etc.) are reserved. Visitors may only use them with express permission from staff, even if their stay has been authorized.

12.3 Visitors of our in‑house guests are required to pay a fee of ₱ 1,000 per person upon request.

12.4 The use of the villas is reserved exclusively for booked guests. No exceptions are possible.

12.5 Visitors of our in‑house guests may remain in the resort until 9:00 PM at the latest.

12.6 Visitors must follow the instructions of staff or management at all times.

13 Opening Times Facilities

Reception:
The reception is open daily from 6:00 AM to 9:00 PM.

Restaurant/Bar:
Open daily from 7:00 AM to 9:00 PM.

Kitchen:
Enjoy our cuisine daily from 7:00 AM to 8:30 PM.

Diving Center:
Discover the underwater world – our diving center is open daily from 8:00 AM to 6:00 PM.

Massage Center:
Relax in our massage center – open daily from 8:00 AM to 7:00 PM.

Swimming Pool:
Enjoy relaxing hours in our swimming pool – open daily from 7:00 AM to 7:00 PM.

14 Liability

14.1 Visitors and guests enter the grounds of Kawayan Holiday Resort at their own risk.

14.2 For the safety of our guests and the resort, Kawayan Holiday Resort keeps three (3) dogs to guard the resort grounds.

14.3 In the Philippines, it is part of the culture to hear animals such as cows, goats, or roosters in the vicinity and to hear music from videos, karaoke, or fiestas in the distance. This is part of the authentic experience. Please understand that the resort does not accept complaints regarding this.

14.4 For safety and liability reasons, Kawayan Holiday Resort does not accept children and teenagers under the age of 16. Our resort is located on a 20-meter-high cliff.

14.5 For the safety of all guests and staff, Kawayan Holiday Resort reserves the right to refuse entry to anyone who poses a danger (e.g., due to illness or violent behavior). A refund is not possible in such cases.

14.6 Please note: Kawayan Holiday Resort accepts no liability whatsoever.

15 Drone flights

15.1 Due to repeated breaches of our drone policy, the resort is now designated a no‑fly zone for drones.
To protect the comfort and privacy of all guests, drones are no longer permitted anywhere on the resort grounds.
Any drones flown in violation of this rule will be confiscated.

The resort accepts no liability for lost or damaged equipment.
